Portrait Session: It is understood that SAMI LEIGH PHOTOGRAPHY is the exclusive, official photographer retained to perform the photographic services requested under this contract. CLIENT and PHOTOGRAPHER agree to arrive at the agreed-upon time and location. All packages include high-resolution edited digital images delivered via an online gallery. RAW or unedited images are not included, and PHOTOGRAPHER retains creative control over image selection and editing. Fees and Payments: CLIENT must pay a non-refundable deposit equal to 50% of the session fee (or specified amount on sign up/application form) to reserve the agreed-upon time and date. The remaining balance is due in full no later than one (1) day prior to the session. All payments are NON-REFUNDABLE. Rescheduling/Late Policy: PHOTOGRAPHER understands that illness or emergencies may require CLIENT to reschedule. Reschedule requests must be made at least 48 hours in advance and will be granted at PHOTOGRAPHER’s discretion. The non-refundable deposit may be applied toward one rescheduled session taking place within 60 days of the original session date. If CLIENT cancels without rescheduling, fails to provide 48 hours’ notice, or does not complete the rescheduled session within 60 days, the deposit will be forfeited. For model calls, collaboration shoots, stylized shoots, and studio sessions, there are no refunds or reschedules due to costs associated with rental space and the purchase of outfits or accessories. In some cases, 50% of deposit may be applied toward a regular outdoor session within 60 days of cancellation. PHOTOGRAPHER reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control without penalty. Sessions will start and end promptly at the contracted time. Additional time will not be added due to CLIENT’s tardiness. Weather/Location Changes: For outdoor sessions, PHOTOGRAPHER reserves the right to reschedule in the event of unsafe or unsuitable weather, location closures, or permit issues. Deposits remain non-refundable. Rescheduled sessions must take place within 60 days of the original session date. Product & Delivery: Galleries will be delivered within three (3) weeks from the session date, provided the session balance is paid in full. Editing does not begin until full payment is received, and late payments will delay delivery. Images will be delivered through an online gallery available for full-resolution digital download. Galleries remain active for three (3) months from the delivery date. Reactivation of expired galleries may require an additional fee. Notice of Copyright: It is illegal to copy or reproduce these photographs without PHOTOGRAPHER’s permission, and violators may be subject to civil and criminal penalties. PHOTOGRAPHER retains copyright to the photographs. Printing and/or distribution rights are granted as noted below. Digital Image Terms of Use: CLIENT may not reproduce, alter, or distribute images beyond personal use. Images may not be edited in any way, including cropping, applying filters, or removing watermarks, including when posted on websites or social media platforms. Model Release: I grant Sami Leigh Photography (“PHOTOGRAPHER”) permission to use photographs and/or videos taken of me, or my minor child, during the agreed session for marketing, advertising, portfolio, website, and social media purposes. This includes the use of first name, last initial, and/or Instagram handle. I understand there is no additional payment or compensation for these uses and release PHOTOGRAPHER from any claims or liability related to the use of these images. This permission also extends to any current or future brands or collaborators associated with PHOTOGRAPHER. Release and Waiver of Liability: I understand that participation in sessions, events, or activities with Sami Leigh Photography may involve dance, movement, and/or outdoor environments that carry inherent risks. While reasonable precautions are taken, I accept full responsibility for my own safety and/or my child’s safety if signing as a parent or legal guardian. I release and waive the right to bring claims against Sami Leigh Photography, its owners, employees, and representatives for any injury, illness, or property damage that may occur before, during, or after participation, including those arising from ordinary negligence. Sami Leigh Photography is not responsible for the actions or omissions of guests, venue owners, or other third parties. In the event of injury or illness during participation, I consent to necessary medical treatment and understand that I am responsible for any related costs.
